BOL’s Official Response to Defamation Campaign

This is the Official BOL Group “Response-To-Defamation-Campaign” Section.

BOL is not just fighting this war for itself. This is a struggle for every individual whose life is about to change with the arrival of BOL. For all those individuals connected with the media industry, especially journalists, who are suffering at the hands of the Saith culture prevalent in the industry; BOL is on a path-breaking mission to change the status-quo and bring about a positive change in the lives of all people in the media industry and Pakistan.

BOL is setting a precedent that will revolutionize the Media Industry. Through its visionary leadership, the core objective behind BOL is the social and economic development of Pakistan. BOL is bringing the best practices to the media industry by providing Pakistan’s largest media infrastructure, efficient management systems to streamline processes, and most of all by offering an extravagant lifestyle and salary packages far above the industry average to its employees by sharing the fruits of its success. This has generated a wave of excitement all around the nation. The huge and overwhelming response is evident from more than 100,000 Job applications that we have received in a short span of less than a month. Moreover, we have also received an encouraging feedback from media professionals and the general public, including best wishes and prayers, as well as positive responses to BOL Group’s branding, identity, leadership, team, careers, and advertising opportunities.

However, the great response we received triggered many sleepless nights for a small and insignificant media group that tried to sabotage our noble mission to revolutionize the media industry in Pakistan, through coercive and unethical ways. And the reason behind this defamation campaign is clear: BOL Group managed to attract a large number of its employees, which added to its insecurity to such a degree that it mounted a well-orchestrated smear campaign against the upcoming channel. It is a pity that they have gone down to this point and have admitted their failure way before playing a healthy role in the competition. However, BOL will not be deterred by these unscrupulous elements seeking to undermine our strengths.

The following is an account of events that unfolded since BOL was announced through a full page advertisement in a leading newspaper:

First of all, these elements used various platforms to defame BOL such as SMSs, emails and blogs. BOL has examined all forensic evidence and knows the identities of these perpetrators. We will bring them to justice and reveal their identities in front of the nation. BOL assures all our stakeholders, especially the general public, that we will continue to lead this fight against all such negative elements. BOL will remain steadfast and protect its noble cause for the benefit of everyone in the media industry.

In this context, Mr. Faisal Sherjaan working as a director for the Geo/Jang Group, which is in direct competition with BOL, bears a mention here. He claims that his organization has nothing to do with his actions and has started a malicious campaign on social media to defame BOL. BOL initially asked him to put the false allegations down, which he didn’t pay heed to.

BOL then reacted strongly by taking him to task and obtained a restraining order against him from the Honorable High Court. He further violated the court order that led to the proceedings of contempt of court being initiated against him.

Later, BOL filed a suit of damages and a criminal complaint against him. Read further details on this.

x

BOL filed a suit of damages worth Rs. 500 million against him for making false allegations.

BOL also filed a criminal complaint against him under relevant sections of PPC following which the Honorable Court has instructed the Police department to initiate the formal proceedings.

BOL will irrefutably ensure the integrity of its cause by pursuing both criminal and civil charges not merely in Pakistan but will also track them at international jurisdiction. This is intended against all those devious elements who seek to undermine this cause by spreading false and baseless rumors against us. We will keep on updating our readers about the progress of all these criminal and civil proceedings.

After this, a frivolous petition was filed against BOL by Mr. Agha Shahid Rasheed, a former PTV employee, in Honorable Lahore High Court, which was disposed off immediately by the Honorable High Court on the very first day.

BOL has initiated civil and criminal proceeding against him under the law. Read further details on this.

BOL filed a private complaint against him under relevant sections of PPC. He was summoned by the Police department.

BOL is in the process of filing a defamation civil lawsuit for damages against Mr. Rasheed for putting forth false pleadings in the court.

Then there were direct attempts to misguide the government functionaries to create legal problems in the operations of BOL however, all such attempts failed.

Then out of frustration a fictitious, malicious, baseless and slanderous story was written by Mr. Saleh Zaafir (who is one of the biggest recipients of secret fund as per the list released by the Honorable Supreme Court) published in Jang and The News. This was a totally false, baseless, incoherent story based on a non-existent court order thus not only liable for criminal and civil proceedings under the defamation ordinance 2002 but also for criminal blackmailing, qazaf, contempt of court and for falsifying the court order to accomplish malicious objectives thus hurting the sanctity and respect of the Honorable courts. Furthermore, certain individuals quoted in the story to whom the author attributed defamatory comments have categorically denied their involvement and even knowledge of this malicious news story.

In this regard, BOL has not just brought the offence to public notice but has also initiated legal actions against Geo and Jang Group, their Editor-in-Chief, Publisher and Reporter/Editor Mr. Saleh Zaafir. Read further details on this.

x

A Lawsuit has been filed in the Honorable High Court demanding them to refrain from writing and publishing malicious contents intended against us. Also, demanding cancellation of their newspaper declarations to stop them from publishing and circulating their newspapers as they are exploiting this medium while using it for blackmailing purposes.

BOL has also issued a legal notice of Rs. 5 billion under the law and will file the damages suit seeking compensation after the prescribed statutory time.

A private complaint was also filed against the offenders under the sections 499, 500 and 501 of Pakistan Penal Code.

Later, some attempts were made to misguide the general public regarding the status of the Satellite TV license of BOL, and rumors were generated that there are certain procedural irregularities in the acquisition of licenses. We would like to clarify that the Satellite licenses were acquired in accordance with the PEMRA rules and regulations and after the completion of all prerequisites and formalities. This is one of the most transparent transfers and in full compliance with all the regulatory requirements of PEMRA, SECP, MOI and other Government Departments.

Recently, a media outlet from the neighboring country, Hindustan times, published the same story which was published by Jang/Geo group and was also under litigation as described in detail above. Ironically, this was published after almost 3 months of its earlier publication apparently on behest of certain dejected pariahs in the Pakistani media industry. This story verbatim carries the same baseless accusations made in the original story without referring to it and the pending litigations in its regard. After the publication of this story, some small media outlets from the neighboring country also picked up that story and re-published it. BOL immediately initiated international litigation against the publication. Within 5 days of publishing the said fabricated story, Hindustan times, realizing the fallacy of this story, removed the false and defamatory story completely from all its properties on internet maintaining high journalistic ethics. Hindustan Times later also regretted the publication of this story on its website by publishing a clarification.

It is important to note that a few months back in a registered criminal case by Axact for Data Theft by its employees (Criminal case No.561/2015), police investigations led to Mr. Sultan Lakhani as the ultimate hidden owner of the company involved in Data theft of Axact and other IT companies and his name was included in the interim police challan (click to see the police challan). After these revelations, Mr. Sultan also tried to transfer the investigations to another police department of his choice but on 12th May 2015 that transfer was also suspended by Sind High Court and criminal investigations began against Mr. Sultan Lakhani. (Click here to view the request for transfer, transfer order and court order suspending the transfer).

As far as the trademark cases are concerned, both the appeal courts and the high courts ruled in favor of Axact. It was proven through courts proceedings that all these cases were forged by GEO and Jang Group and there was no substance to any of their claims. For further information on this please read the statement of Intellectual Property Organization of Pakistan (click to see the statement).

BOL will ensure the integrity of its cause by pursuing both criminal and civil charges against all those who seek to undermine this cause by spreading false and baseless rumors against us. These actions will not only be taken in Pakistan, but also in other countries around the world, especially the U.A.E, U.S.A, U.K, and any other place. We will keep our readers updated with all the civil and criminal proceedings that are being carried out.

Due to the revolutionary leadership, quality lifestyle, best team, advanced systems and processes, best products, Pakistan’s largest media infrastructure and millions of prayers and well wishes,

BOL has become Pakistan’s Largest Media Group.
